According to the tech website 9to5mac, U.S. federal judge Mark Pittman has asked Elon Musk's company to provide details and disclose whether there is an agreement that led to the withdrawal of its antitrust lawsuit against Apple.
This week, X and SpaceXAI filed a motion stating that they voluntarily withdrew their claims against Apple in last year's lawsuit against Apple and OpenAI, and will not bring them up again.
Original Complaint: Apple and OpenAI Colluded to Suppress Competitors
According to the original complaint, X and SpaceXAI accused Apple and OpenAI of colluding to prevent competitive AI apps from gaining visibility on the App Store, due to an agreement between the two parties to integrate ChatGPT into Siri and Apple Intelligence. Apple and OpenAI have denied these allegations.
However, in the documents submitted this week, X and SpaceXAI only stated that they had "resolved the claims against Apple in this case" and emphasized that they did not seek to withdraw the claims against OpenAI.
Judge Pittman, who is presiding over the case, has ordered X and SpaceXAI to provide the court with "any agreements or combination of agreements reached with Apple related to resolving the claims made by the plaintiff against Apple in this case." This order was a response to an emergency motion filed by OpenAI — requesting the court to compel X and SpaceXAI to submit the agreements they reached with Apple to resolve the dispute. Judge Pittman also ordered the two companies to respond to OpenAI's motion by noon on September 17th local time.
