While artificial intelligence brings convenience, the false information it generates is gradually crossing legal boundaries. Recently, the highly anticipated first case of "defamation by AI large model" in China reached a final judgment in Nanjing, Jiangsu.
The case originated from a practicing lawyer in Jiangsu, Li Xiaoliang. When he used Baidu's "AI intelligent answer" product to search for himself, he was surprised to find that the AI-generated search results included serious defamatory false information such as "being sentenced to three years in prison." As a lawyer, there are high requirements for reputation and compliance, and this fabricated criminal record had a negative impact on Li Xiaoliang's personal reputation and career.
In response to this serious "AI rumor-mongering" behavior, Li Xiaoliang subsequently filed a lawsuit against Beijing Baidu Net Technology Co., Ltd., demanding that the company bear the liability for infringement.
After reviewing the case, the court ruled that AI large models should ensure the authenticity and objectivity of the information when generating content and should not spread false facts that damage others' reputation. As the operator of the AI product, Baidu Company was found to have infringed on Li Xiaoliang's right to reputation through the involved response, and must bear legal consequences.
According to the final judgment by the Nanjing court, Baidu Company was determined to constitute defamation. The court ordered the defendant to issue a written apology letter to the plaintiff Li Xiaoliang within ten days of the judgment taking effect to eliminate the negative impact.
This case's conclusion not only clarifies the clear legal boundary for content generated by artificial intelligence, but also reminds major AI research institutions: algorithm recommendations and AI answers are not beyond the law. Developers must simultaneously strengthen the verification of the authenticity and compliance management of the output content while exploring ways to improve model capabilities.
