Recently, the National Association for the Advancement of Colored People (NAACP) filed a lawsuit against Elon Musk's artificial intelligence company xAI in the federal court of Mississippi, accusing the company of illegally discharging toxic pollutants in Black communities in the Memphis area. The lawsuit claims that xAI violated the Clean Air Act while operating a temporary power plant in Southaven to supply electricity to its data center in South Memphis.
The lawsuit was filed on behalf of the NAACP by the Southern Environmental Law Center and Earthjustice, stating that xAI used dozens of unpermitted methane gas generators, causing pollution in historically Black communities nearby. The NAACP is calling for an end to xAI's operation of these unauthorized turbines in Southaven.
DA Derrick Johnson, chairman and CEO of the NAACP, said, "Large corporations like xAI often view our communities and homes as obstacles to be ignored." xAI's data centers are referred to by Musk as "Colossus" and "Colossus II," with "Colossus II" covering an area of 1 million square feet in Memphis, near residential areas that have long suffered from harmful pollution.
The lawsuit states that xAI illegally installed and operated up to 27 large bus-sized gas turbines, emitting significant amounts of harmful nitrogen oxides and other toxic chemicals, such as formaldehyde, annually. In response, xAI stated, "We take our commitment to the community and environment very seriously, and the operation of temporary power equipment complies with all applicable laws." However, xAI did not respond specifically to the alleged violations mentioned in the lawsuit.
A higher percentage of Black residents live in the Memphis area, facing a higher risk of asthma and respiratory diseases, with lower life expectancy than other parts of the city, and four times the national average cancer risk. Johnson emphasized, "We cannot normalize this environmental injustice, where billionaires set up polluting companies in Black communities without accountability. We will not let xAI escape punishment."
The NAACP is seeking an injunction, civil penalties, and litigation costs. Meanwhile, despite support from Memphis Mayor Paul Young and the chamber of commerce, local residents and environmental organizations are actively opposing the project, urging local government to take action to protect air quality.
