Recently, Elon Musk's X Company has achieved a significant victory in its legal battle with Apple and OpenAI. On November 14, U.S. District Judge Mark Pittman in Fort Worth, Texas, rejected Apple and OpenAI's request to dismiss the lawsuit filed by Musk.

This lawsuit involves allegations of monopoly in the smartphone market and the generative AI chatbot market, with X Company and Musk's AI startup xAI accusing both companies of colluding to eliminate competitors through unfair means.

Judge Pittman's ruling allows X Company and xAI to continue with the litigation, marking an initial victory in their struggle over AI and competition among tech giants. xAI acquired X Company in March this year for $3.3 billion, and the collaboration background has attracted widespread attention in the industry. Judge Pittman stated in the ruling that this decision does not represent the final determination of the facts of X Company's allegations, and further hearings on related factual disputes will continue.

In last year's lawsuit, X Company accused Apple of violating antitrust laws by exclusively integrating ChatGPT into the Apple Intelligence feature on iPhone devices. They pointed out that Apple's partnership with OpenAI put competitors at a disadvantage. At the same time, X and xAI also accused Apple of listing ChatGPT as a "must-have app" in its App Store and intentionally marginalizing other competing products, thereby strengthening market exclusivity. In its application to dismiss the lawsuit, Apple emphasized that its collaboration with OpenAI was not an exclusive agreement and stated that users could still access various chatbots through other means.

Regarding this lawsuit, OpenAI also said that Musk has launched a "legal battle" against it and ChatGPT. Meanwhile, Musk has separately filed a lawsuit against OpenAI and its leaders in the U.S. Federal Court in California. It is worth noting that since its launch at the end of 2022, ChatGPT from OpenAI has become the fastest-growing product in consumer applications.

As of the time of writing, Apple, OpenAI, and X Company have not made any public comments on this matter.
